Letter To Patient Explaining "Secondary Gain" and need to give only a true presentation of symptoms and behavior:

(I find it a good policy to present this summary statement to the Injured Worker entering treatment.)

Dear Patient:

My experience in treating Injured Workers reveals the Injured Worker will try to show the treating doctor all the important signs and symptoms of which they are suffering. This is correct and proper to do.

It is appropriate and reasonable to put yourself in a good light so the doctor and the Employer and Carrier know and understand all aspects of your injury and case. To put yourself in a good light so as to fairly benefit yourself is called: Fair, reasonable Secondary Gain. Unreasonable Secondary Gain is: added on, undeserved money and/or benefits such as dependency, help from others when you can do things yourself, or getting unnecessary sympathy because you are regarded as a disabled worker. It is letting others do things for you when you can do it yourself.

Unfortunately, many Injured Workers will overact and exaggerate their Signs, Symptoms, and Pain Behavior thinking it will benefit them in the final resolution of their case. Such exaggerated Pain Behavior does not serve you well and will turn off your doctor and all concerned in the case and/or litigation. It will get you labeled a faker. It is important that you make every effort to give an honest and truthful presentation and not be labeled a faker.

A genuine presentation will be appreciated and will assist the doctor to know exactly what is going on with your injury, physical and mental condition, and personal aspects of your life that are important in understanding your case.

People should have nothing to hide and should tell the truth. If they are A True Patient with true injuries they will receive what is owed them. However, if they exaggerate or overact their behavior, it will be noted and described in the medical record for each appointment and will only hurt their case in the long run. When you are on the level and present to the doctor your true picture — treatment will be shortened, recovery hastened and re-entry more quickly established, so you may get on with the next era of your life.

The reason for presenting this to the Injured Worker office population and not to the regular patient population is that when litigation is a factor in a case, people in the Worker’s Comp System are suspicious that the IW will have Secondary Gain motives to exaggerate or fake their signs and symptoms. It is important that the IW not exaggerate, or give the impression of having inordinate Secondary Gain purposes driving their case. Some Secondary Gain, as mentioned above, is appropriate. Too much is improper!
